Terms and Conditions of Use and Sale
Please read these conditions carefully before using SCTY Group Services. By using SCTY Group Services, you agree to be bound by these terms. We offer a wide range of services, and additional conditions may apply. Furthermore, every time you use any SCTY Group service, you will also be subject to the general terms and conditions, as well as the specific conditions applicable to that particular service.
Electronic Communications
Each time you use an SCTY Group Service or send us an email, SMS, or other communication from your computer or mobile device, you are communicating electronically with us.
We will contact you electronically via different channels, including:
- Text messages (SMS)
- Notifications within applications
- Published messages on the website
- Other communication tools such as our messaging service
By accepting this agreement, you consent that all contracts, notices, and other communications sent electronically meet the legal requirement for written communication, unless applicable law mandates a different format.
Recommendations and Personalization
As part of SCTY Group Services, we may recommend features, products, and services, including third-party advertisements, that could be of interest to you. We use this information to identify your preferences and personalize your experience.
Copyright, Intellectual Property, and Database Rights
All content hosted or made available through any SCTY Group Service, including:
- Text
- Graphics
- Logos
- Button icons
- Images
- Audio clips
- Digital downloads
- Data compilations
is the property of SCTY Group or its content providers and is protected by Mexican and international laws concerning intellectual property, copyrights, and database rights.
The entire collection of content hosted or made available through any SCTY Group Service is the exclusive property of SCTY Group and is protected under applicable laws.
- Systematic extraction or reuse of any part of SCTY Group content is prohibited without explicit written consent.
- Search tools or data extraction robots may not be used to extract substantial portions of SCTY Group Services without explicit written permission.
- Users may not create or publish their own databases containing substantial portions of SCTY Group Services, including product listings and pricing, without explicit written authorization.
Registered Trademarks
You can review a non-exhaustive list of SCTY Group trademarks. Additionally, the graphics, logos, page headers, button icons, scripts, and service names included or available through SCTY Group Services are either registered trademarks or trade dress of SCTY Group.
SCTY Group trademarks and trade dress cannot be used in connection with any product or service that does not belong to SCTY Group, nor in any manner that could cause confusion among users, diminish, or discredit SCTY Group.
All other trademarks not owned by SCTY Group that appear within or are available through SCTY Group Services belong to their respective owners, who may or may not be affiliated with, related to, or sponsored by SCTY Group.
License and Access
Subject to your compliance with these Terms of Use and the General Terms of Service, as well as payment of any applicable fees, SCTY Group or its content providers grant you a limited, non-exclusive, non-transferable, and non-sublicensable license to access and use SCTY Group Services for personal, non-commercial purposes.
This license does not include:
- Any resale or commercial use of SCTY Group Services or their content.
- The right to compile or use product lists, descriptions, or prices.
- The right to make derivative uses of SCTY Group Services or their content.
- Downloading or copying account information for the benefit of another company.
- Using search tools, data mining robots, or similar extraction technologies.
SCTY Group, its licensors, providers, publishers, rights holders, and other content suppliers reserve all rights not expressly granted under these Terms of Use or General Terms of Service.
Reproduction, duplication, copying, sale, resale, or exploitation of SCTY Group Services or any portion thereof for commercial purposes is strictly prohibited without our prior written consent.
Your Account
To use certain SCTY Group Services, you may need to register an SCTY Group account and associate a valid payment method with it. If a payment issue arises, we may charge an alternative valid payment method linked to your account.
When using SCTY Group Services, you are responsible for:
- Maintaining the confidentiality of your account details and password.
- Restricting access to your computer and devices.
- Accepting full responsibility for all activities conducted under your account or password, to the extent permitted by applicable law.
You must take all necessary measures to secure your password, and notify us immediately if you suspect:
- Your password has been compromised.
- Unauthorized use of your account.
- Potential security risks.
You are responsible for ensuring your account details are correct and complete and must inform us immediately of any changes. You can access and update your information through the website section "Protect Your Privacy" under the Help pages.
Prohibited Use of SCTY Group Services
You may not use SCTY Group Services to:
- Damage or disrupt SCTY Group Services or interrupt access to them.
- Engage in fraudulent activities, commit criminal offenses, or partake in any illegal conduct.
- Cause inconvenience, disturbance, or distress to any third party.
SCTY Group reserves the right to:
- Deny service access,
- Terminate accounts,
- Delete or modify content if users violate applicable laws, these Terms of Use, or any other policies.
Sales
The www.scty.mx website allows users to:
- Purchase various products
- Contract different services in a reliable, secure, and convenient manner
To ensure a comprehensive service experience, users must fully accept the General Terms of Sale.
If a user disagrees, either in whole or in part, with the established terms, they must refrain from purchasing or contracting any products or services offered through the website.
Because of the importance of these terms, it is essential to highlight that purchasing or contracting services through the website constitutes acceptance of these General Terms of Sale.
Definitions
- Website: The website available through the domain www.scty.mx.
- Available Product: Any type of goods or services—regardless of their nature—offered on the website for purchase, acquisition, or contracting, even if provided for free. When referring to more than one available product, they will be called "available products."
- Acquired Product: Any type of goods or services—regardless of their nature—once purchased, acquired, or contracted by users of the website. When referring to more than one acquired product, they will be called "acquired products."
- User: Any person—regardless of their nature—who uses the website, particularly if they purchase, acquire, intend to purchase or acquire, contract, or intend to contract the available products offered on the website.
- Owner: The legal owner of the website, SCTY Group, who is the sole entity responsible for marketing available products on the site. The Owner can be contacted through the following channels:
- Purchase Order: A document generated on the website that contains the set of acquired products by the user, which the Owner is committed to delivering or providing.
User Responsibilities
Legally, all users are considered capable of entering contracts and legally committing to the terms of this document. As such, every user is obligated to use the website responsibly and correctly, agreeing to:
- Legally purchase, acquire, or contract the available products. If the user becomes aware of any circumstances that could legally affect the website's operations, they must immediately notify the Owner.
- Not engage in fraudulent purchases or acquisitions. If a user is found to have participated in fraudulent or simulated transactions, the order may be canceled, and authorities will be notified.
- Provide accurate information when required to contract, acquire, or purchase available products, even if the product is offered for free.
The website is primarily intended for users residing in Mexico, and SCTY Group does not guarantee compliance with laws in other countries. Therefore, the Owner declines responsibility for any legal consequences arising from using the website outside of Mexico.
Additionally, these terms may be modified at any time, and users are responsible for reviewing updates. However, if a user purchases, acquires, or contracts a product on the website, the terms published at the time of the transaction will apply.
Purchases and Acquisitions
Users may purchase, acquire, or contract available products on the website by:
- Following the enabled procedures,
- Providing requested details, and
- Making the corresponding payment, if applicable.
Once a user completes the acquisition or contracting process, they will receive a purchase order, which will specify the acquired products—meaning the goods and/or services purchased, acquired, or contracted.
The purchase order must include:
- The delivery date for products,
- The service execution date, or
- The start date of service provision.
If there is any non-compliance by the Owner, or if the acquired product is unavailable, the user must report the issue to the Owner so that:
- The Owner can take appropriate measures to satisfy the user’s requirements.
- The payment received may be refunded, if necessary.

The Owner may send the user both the purchase order and invoice, provided that the user supplies the necessary information.
If the user needs to clarify details about their order or acquired products, they may contact SCTY Group via info@scty.mx.
Depending on their nature, some available products may require the acceptance of specific conditions for purchase, acquisition, or contracting. These conditions will be available for each product or category, and users can consult them at any time.
Unless explicitly stated otherwise, the Owner is not the manufacturer of the available products on the website. As a result, users should not solely rely on the information provided on the website but should also review the instructions and warnings included in the product labeling, manuals, and descriptions accompanying acquired products.
All website activity may be recorded or stored by the Owner exclusively for the following purposes:
- Tracking purchase orders and payments processed through the website to ensure service quality and customer support.
- Providing evidence of website transactions for legal matters related to competence or interest.
- Improving services on the website, including enhancing the user interface, streamlining acquisitions and contracts, and offering personalized product recommendations based on user preferences.
In all cases, personal data protection laws will be followed. Any questions or clarifications regarding this policy or the exercise of user rights under data protection laws may be found in our Privacy Notice.
Payment Methods and Pricing
- The prices displayed on the website are final and include taxes.
- Prices are shown in Mexican pesos, unless otherwise legally required.
- Shipping costs are not included unless explicitly stated.
- If the Owner manages the shipment, the shipping cost may be added to the total price.
- If the user handles shipment directly, they must review the available shipping methods and costs and choose the option that best suits their needs.
Products or services will never be added automatically to an order. The user only pays for acquired products, and if any additional charges appear, they must immediately report them to the Owner via info@scty.mx.
Prices may change at any time, but modifications will not affect purchases or contracts for which the user has already received a purchase order.

All payments are subject to verification, and the purchase order will only be generated once:
- The funds are available to the Owner, or
- The payment has been authorized by the financial institution or payment processor.
SCTY Group is not responsible for payment rejections or authorization delays by financial entities or payment processors.
If a payment is rejected or delayed, the Owner may unilaterally cancel the purchase and refund any amounts paid by the user.
Similarly, in such cases, shipping or product delivery may be suspended or delayed until payment is successfully processed, without liability for the Owner.
Payment Verification and Refunds
If a payment verification process detects a pricing error caused by an issue outside the Owner’s control, such as website malfunctions, the Owner may immediately suspend the purchase order and refund the user for any paid amount, without liability to the Owner.
The user acknowledges that charges may be processed at the time of product request, meaning before receiving the goods, products, or services they purchase, acquire, or contract.
User Rights
If a user acquires products through the website, they are entitled to all consumer rights granted under Mexican law, including:
- Knowing the total price before purchasing or contracting goods, products, or services offered on the website.
- If purchasing goods for human or animal consumption, the user has the right to know, before purchase, the ingredients, substances, and components, as well as:
- Properties and characteristics
- Expiration date
- Net content, drained weight or mass
- Warnings related to consumption and storage
- Receiving an invoice, receipt, or proof of purchase, which may be included or attached to the purchase order and must contain specific details of the transaction.
- Ensuring that their provided information remains confidential and cannot be shared or transmitted to other providers or sellers outside the transaction, except by court order.
- Knowing the physical address, phone number, and necessary contact details for filing claims or requesting clarifications before completing a transaction.
- If purchasing goods, the user has the right to withdraw from the purchase within 21 calendar days, without justification. If the goods require shipping, withdrawal is permitted until the product has been shipped by the Owner. In such cases, the user has the right to a full refund of all payments made.
The user can withdraw from a purchase, acquisition, or contract by emailing info@scty.mx.
Product Returns
The user has 7 calendar days from the date of receipt to return acquired products.
- Refunds will only cover the product’s cost—not shipping or delivery expenses.
- To initiate the return, the user must notify the Owner via info@scty.mx or return the product directly to:
Av. Juan Pablo II 595A, El Pipón, Tepatitlán de Morelos, Jalisco, C.P. 47650. - If the return requires shipping the product to the Owner, the user will cover shipping costs.
- The user is responsible for any reduction in product value resulting from handling beyond what is necessary to assess its nature, characteristics, and functionality.
Exceptions to Returns
Returns are not accepted for:
- Personalized products
- Perishable or quickly expiring goods
- Optical media storing music or video without packaging
- Hygiene-related or health-related sealed products if the seal has been removed after delivery
- Discounted or promotional products
Return Process and Conditions
The user agrees that all returns must be made using:
- Original packaging
- Instructions and accompanying documents
- A copy of the invoice, receipt, or proof of purchase
For services, the user cannot withdraw after completion, but may file a claim for service quality deficiencies.
- If services are still in progress, the user may withdraw by paying 20% of the total service cost, plus expenses incurred by the Owner to fulfill the request.
- If services are subscription-based or accessed via a license, the user may cancel while covering the cost of the current billing period. Users may continue receiving the service until the paid period expires.
The user must clearly and unequivocally communicate their decision regarding returns or cancellations.
Defective or Incorrect Products
If a user receives products that do not match their purchase order, they must immediately contact the Owner via info@scty.mx, stating:
- The issue (defective product or incorrect item received)
- Any discrepancies between the delivered and ordered items
Incorrect Product Received
- The user must return the mistakenly delivered items.
- The Owner will ship the correct items again, covering all shipping and transportation expenses.
Defective Product Received
- The user must contact the Owner via the email provided.
- The Owner will inform the user of the return process.
- Once the product is reviewed, the Owner will confirm within a reasonable period (maximum 7 days) whether a refund or replacement is warranted.
Refund and Replacement Timeline
Refunds or replacements will be processed as soon as possible and no later than 30 days from the date when the refund or replacement request is approved.
- If a refund is issued due to a defective product, the user will be reimbursed for all expenses, including delivery and return shipping costs.
Product Warranties
The user has access to warranties offered through the website for acquired products, in compliance with Mexican consumer protection laws. The Owner is responsible for product defects under the terms of the applicable warranty.
Additionally, the user may claim warranties directly from third-party manufacturers of acquired products. In such cases, the user may contact the manufacturer or brand to exercise their rights as long as the warranty remains valid.
Liability Exclusions
The user releases the Owner from any liability in the following cases:
- If the Owner fails to fulfill obligations due to events beyond their control, such as force majeure, unforeseen circumstances, or third-party failures on which the Owner depends to fulfill responsibilities.
- If such failures result in lost profits (including lost income, expected savings, additional expenses, or failures in the user's obligations to third parties) or any direct or indirect loss that was not reasonably foreseeable at the time of purchasing, acquiring, or contracting the acquired products, the Owner is not liable for such losses.
- If the failures stem from a delivery company’s non-compliance, or from external factors such as strikes, road closures, vandalism, protests, or other external disruptions that may delay delivery or cause damage or loss of the product. This applies even if such events cause delays, suspensions, or malfunctioning of contracted services.
In these cases, the Owner’s obligations will be suspended for the duration of the event preventing fulfillment and will be extended for the same period beyond the original deadline. The Owner will take reasonable measures to find solutions or alternatives to fulfill obligations despite disruptions.
Additionally, the Owner will not be responsible if non-compliance results from laws, decrees, administrative orders, or judicial mandates.
The Owner is also not responsible for misuse or wear of acquired products due to user usage. Likewise, if the user returns a product, the Owner will not be liable for incorrect returns—the user must return the correct product.
Furthermore, the Owner is not liable for minor, minimal, or imperceptible differences between the received product and promotional images shown on the website.
Waivers and Nullity
- The Owner’s waiver of any specific legal right does not constitute a waiver of other rights or actions related to the contract or these General Terms, nor does it exempt the user from fulfilling obligations.
- Any waiver by the Owner must be in writing, specifying the right or action being waived and the terms for enforcement.
- If the Owner fails to require compliance from the user, this does not constitute a waiver of the Owner’s legal rights or enforcement actions, nor does it imply the user has fulfilled obligations.
- If any clause of these General Terms is declared null or invalid by a competent authority, the remaining clauses and content remain in effect and are not impacted by the declaration of nullity.
Gift Card Terms
SCTY Group Gift Cards are issued by Shopify Inc. (151 O’Connor Street, Ground Floor, Ottawa, ON K2P 2L8, Canada).
- Gift Cards automatically add balance to your SCTY Group account when you reload your balance, receive a "contribution," or use an SCTY Group Cash barcode ("Gift Cards").
- Your SCTY Group Balance reflects the total outstanding balance of all applied Gift Cards that have not yet been used in purchases.
- This balance may be referred to as "SCTY Group Balance" or "Gift Card Balance."
- To check your balance, visit Your Account.
- Purchases are deducted from the SCTY Group Balance, and unused balances remain associated with the user’s SCTY Group account.
- If a purchase exceeds the SCTY Group Balance, the remaining amount must be paid using another payment method.
Redeeming a Gift Card
- Users receive SCTY Group Gift Cards and account balance via email, including a unique code.
- Some Gift Cards can be printed and given in physical format to recipients.
- To redeem the code, users can:
- Click the email link (if applicable), or
- Enter the unique code during checkout in the online store.
Redeeming your Gift Card or SCTY Group Credit adds its value to your account balance, allowing you to pay for orders at stores that accept this payment method.
Users must have an SCTY Group account or register a new account to redeem Gift Cards or SCTY Group Credit.
Once a Gift Card or SCTY Group Balance has been redeemed, it cannot be refunded for cash or transferred to another account.
Users must redeem SCTY Group Balance before a specified expiration date, based on the conditions of the promotion or offer. If not redeemed before the deadline, the balance may expire.
Using SCTY Group Gift Cards and Balance
Purchases made through the SCTY Group online store that meet eligibility criteria can be paid using SCTY Group Gift Cards and SCTY Group Balance.
To buy with a SCTY Group Gift Card or Balance, you must browse the www.scty.mx website to find available offers and promotions for Gift Cards.
When completing your order, you can apply your Gift Card or SCTY Group Balance to eligible purchases.
- Gift Cards or Balance cannot be used to pay an SCTY Group invoice or to shop at stores that do not accept SCTY Group Gift Cards.
If your order total is less than your Gift Card or Balance, the remaining amount stays in your account for future purchases.
If your order total exceeds your Gift Card or Balance, you must pay the difference using another authorized payment method within the online store.
Limited Liability for Gift Cards
SCTY Group is not responsible for SCTY Group Gift Cards or Product Gift Cards after activation, if they are lost, stolen, deactivated, or damaged.
- SCTY Group Gift Cards and Product Gift Cards should be treated like cash.
Gift Card Refunds
If you initiate a return using the online returns process for items purchased with a combination of payment methods, refunds will be processed as follows:
- Primary refund is applied to other payment methods used.
- Remaining balance is refunded to an electronic SCTY Group Gift Card.
You will receive the electronic Gift Card once the return process is completed. For more details, visit the Returns section.
- You must provide a valid email address to receive the SCTY Group electronic Gift Card.
- If the email cannot be verified, SCTY Group reserves the right to withhold the electronic Gift Card delivery.
SCTY Group Gift Cards cannot be exchanged for cash.
Gift Card Limitations
- SCTY Group Balance cannot be used to buy other Gift Cards, open-loop prepaid cards, or certain third-party gift cards.
- Gift Cards cannot be:
- Reloaded, resold, or used for payments outside www.scty.mx or affiliated properties.
- Used for advertising, marketing, contests, or unauthorized promotions.
- Transferred for value, redeemed for cash, or refunded for cash, except where required by law.
- Used for prohibited purposes under SCTY Group’s Gift Card restrictions.
- SCTY Group Balance and Gift Cards cannot be transferred to another SCTY Group account.
- They cannot be used for purchases of services or products at SCTY Group-affiliated properties outside of Mexico.
Risk of Loss for Gift Cards
The risk of loss and ownership of Gift Cards passes to the buyer once SCTY Group:
- Electronically transmits the Gift Card to the buyer or designated recipient, or
- Delivers the Gift Card to a shipping provider, as applicable.
Gift Cards must be purchased directly from SCTY Group or an authorized third party.
The user is responsible for protecting their SCTY Group Balance or Gift Card from unauthorized use.
- SCTY Group is not liable for lost, stolen, or destroyed Gift Cards, nor if a SCTY Group Balance or Gift Card is used without permission.
- Various Gift Card scams exist, requesting payments via Gift Cards. SCTY Group is not responsible for illegal activities or fraud conducted by third parties related to any Gift Card transaction.
Violations of Gift Card Terms and Conditions
By using a Gift Card, you agree to these Terms and Conditions and commit to not using the Gift Card in a fraudulent, deceptive, unfair, or harmful manner toward SCTY Group, its affiliates, or its customers.
SCTY Group reserves the right—without prior notice—to:
- Invalidate Gift Cards, including components of your SCTY Group Balance, without refund.
- Suspend or terminate customer accounts.
- Restrict access to SCTY Group services.
- Cancel or limit orders.
- Charge alternative payment methods if we suspect fraudulent, illegal, or non-compliant use of a Gift Card or SCTY Group Balance.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCTY GROUP MAKES NO EXPRESS OR IMPLIED WARRANTIES REGARDING GIFT CARDS OR SCTY GROUP BALANCE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IF A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY AND SCTY GROUP'S ONLY RESPONSIBILITY WILL BE TO REPLACE THE GIFT CARD.
Agreement Integrity
These General Terms and all referenced documents, including product descriptions, images, and texts, constitute the entire agreement between the user and the Owner concerning:
- Purchases, acquisitions, contracts, or legal transactions made on the website.
This agreement supersedes any previous verbal or written agreements between the parties.
Governing Law and Jurisdiction
The access, navigation, and use of the website, as well as the acquisition, purchase, and/or contracting of available products, are governed by Mexican law, specifically in Guadalajara, Jalisco.
Any disputes, issues, or disagreements regarding the interpretation or application of these General Terms will be handled under the jurisdiction of the appropriate courts in Guadalajara, Jalisco, Mexico.
